These Terms of Service ("Terms") govern your access to and use of our website located at www.therecoverystate.com ("Website") and any related services. The Recovery State is a registered trade name of Reveles Enterprises LLC, a Washington limited liability company. By browsing our Website, submitting payment, or purchasing equipment, you agree to be legally bound by these Terms.

 

2. Eligibility

By using our Services, you represent that you are at least 18 years of age. Our products are heavy, high-ticket wellness units intended strictly for adult operation. Minors are prohibited from purchasing products or registering accounts on our Website.

 

3. Medical and Wellness Disclaimer

  • Not Medical Advice: All content on this Website (including text, specifications, guides, and graphics) is provided for educational and informational purposes only. It is not a substitute for professional medical advice, clinical diagnosis, or treatment.
  • Physician Consultation: Always consult your physician before using thermal heat therapy or cold-water immersion equipment, particularly if you have cardiovascular conditions, high or low blood pressure, respiratory issues, are pregnant, or are taking medication.
  • Voluntary Assumption of Risk: Sauna heat exposure and cold plunge immersion involve physiological cardiovascular stress. You knowingly, voluntarily, and expressly assume all risks—including physical injury, fainting, hypothermia, or hyperthermia—associated with the purchase, placement, and operation of this equipment.

 

4. Orders, Custom Manufacturing, and Modifications

  • Pricing & Availability: All transactions are processed in USD. We reserve the right to correct pricing errors, inaccuracies, or omissions at any time prior to order dispatch.
  • Fraud Prevention & Identification: Due to the high value of our catalog, we reserve the right to verify customer identity prior to fulfillment. Orders flagged by our payment processors may require a government-issued photo ID matching the verified billing address before releasing cargo.
  • Custom & Built-to-Order Production: Outdoor saunas and selected hydrotherapy tubs are custom-crafted to order. Specifications (heater type, wood species, and accessories) enter formal manufacturing locks 14 calendar days after order placement.
  • Manufacturer Modification Fees: Any customer-requested order alterations submitted after 14 days of order placement, or within 7 calendar days of scheduled factory shipment, are subject to a mandatory, non-negotiable $350.00 manufacturer modification fee.

 

5. Site Preparation, Permitting, and Installation Liability

  • Independent Installation: The Recovery State and Reveles Enterprises LLC are retailers of equipment only. We do not provide installation, foundation construction, or electrical/plumbing contracting services.
  • Foundation Requirements: The customer is solely responsible for verifying that the installation site (deck, concrete slab, patio pavers, or crushed stone) meets structural load-bearing requirements for both equipment dry weight and filled water/bather weight.
  • Licensed Trades & Codes: All hardwired 240V electric sauna heaters, wood-burning chimney flues, and dedicated electrical lines must be installed by fully licensed and insured professionals. The customer is exclusively responsible for obtaining any required local building, zoning, HOA, or electrical permits.
  • Waiver of Property Damage: Reveles Enterprises LLC disclaims all liability for structural damages, water leaks, electrical fires, deck failure, or improper venting resulting from third-party installation.

 

6. Shipping, Freight Acceptance, and Storage

Your purchase is governed by our Shipping Policy, which is incorporated into these Terms by reference:

  • Delivery Scope: Deliveries are strictly residential curbside via commercial LTL freight trucks. Drivers are not permitted to bring crates into backyards, homes, or garages.
  • Crate Dimensions & Liftgates: Liftgate service is restricted by freight regulations to crates measuring 84 inches or shorter. For oversized crates (exceeding 84 inches), the recipient is legally responsible for curbside unloading assistance or equipment.
  • Specialized Transit: Services requiring flatbed, tilt-tow, or tow truck delivery are specialized freight requests ($1,450+ surcharge) and are never covered under standard complimentary curbside freight.
  • Short-Notice Delivery Holds & Storage: Requests to postpone delivery submitted within 7 days of the scheduled ship date, or freight stored at a terminal past free-time windows, will be billed to the customer at $35.00 per day.

 

7. Returns, Cancellations, and Dispute Process

Your order is governed by our Refund and Cancellation Policy, incorporated herein by reference:

  • Custom Goods Final Sale: Handcrafted, built-to-order timber units are strictly non-returnable and non-cancellable once production begins.
  • Chargeback Agreement: If an issue arises with transit, delivery delay, or damage, you agree to follow our inspection and transit resolution claims process. Initiating an unauthorized chargeback or payment reversal without providing the requisite BOL damage notes and 48-hour reporting windows constitutes a material breach of these Terms. The Company reserves the right to recover all chargeback fees, administrative costs, legal fees, and collection expenses incurred.

 

8. Intellectual Property Rights

All content contained on this Website—including logos, product graphics, brand copy, media files, and custom designs—is the exclusive intellectual property of Reveles Enterprises LLC and its licensors. You may not scrape, mirror, duplicate, or redistribute any portion of our site without express prior written consent.

 

9. Disclaimers and Limitation of Liability

  • "As Is" Basis: All products and services are sold on an "as is" and "as available" basis. The Company makes no warranties beyond those expressly provided by the original equipment manufacturer.
  • Limitation of Damages: Under no circumstances shall Reveles Enterprises LLC, its officers, employees, or affiliates be liable for indirect, incidental, punitive, or consequential damages (including lost profits, property damage, or installation downtime).
  • Maximum Dollar Cap: The maximum cumulative liability of Reveles Enterprises LLC for any claim arising from your purchase shall not exceed the actual total dollar amount paid by you to the Company for the specific product at issue.

 

10. Governing Law and Dispute Venue

These Terms and any contractual disputes arising between you and the Company shall be governed strictly by the laws of the State of Washington, without regard to conflict of law principles. You irrevocably agree that any formal dispute, mediation, or legal proceeding will take place exclusively in the state or federal courts located in King County, Washington.
